Ongoing + Emerging E&O Issues

Misc. E&O: Competition remains strong, while traditional service failures continue to drive claims. AI-assisted professional services exposures continue to evolve, warranting closer review of policy definitions, exclusions, and coverage triggers. Appetite remains class-specific, so tailored forms and endorsements matter. Experienced wholesale placement remains important for comparing coverage, avoiding gaps, and balancing competitive pricing against the actual services performed. Confirm that all disclosed services match the coverage purchased.

A+E: Favorable risks remain stable, but challenging projects and loss histories can attract higher pricing or deductibles as claim severity and defense costs rise due to social inflation, particularly for firms involved in large infrastructure, geotechnical, structural, and residential projects. Renewal expectations should reflect project mix and loss experience rather than universal firming; start early and compare available capacity, minimum premiums, and terms.

Contractors Professional/Pollution: Capacity remains available, with complex projects pressuring retentions and PFAS exposures drawing pollution scrutiny. Forms differ: some emphasize pollution with limited professional coverage; others offer broader professional protection, sometimes including faulty workmanship. Check class and project restrictions, coverage triggers, and exclusions before treating products as interchangeable.

Lawyers: Capacity remains stable despite rising malpractice and defense costs, with AI-related claims emerging. Underwriters continue to scrutinize practice mix and application changes, especially at smaller firms. Document human review of AI-assisted work and maintain client safeguards.

Real Estate: Competitive appetite continues for traditional real estate risks. Title agents, mortgage brokers, multifamily construction, and redevelopment warrant closer underwriting attention. For risks with FI investment exposure, carriers scrutinize property-level single-purpose entity (SPE) schedules and automatic-insured provisions to assess affiliated-entity coverage. Fund and investment manager risks warrant attention to valuation disputes, investor claims, and conflicts of interest, while carriers continue to review operational exposures arising from owned and managed real estate assets.
